1. About us and these Terms

These Terms & Conditions apply to swimming lessons provided by Aquababies Yorkshire Ltd (company number 17256237), registered office 4 Waterfront Mews, Apperley Bridge, Bradford BD10 0UR. Contact: info@aquababies-yorkshire.co.uk or 07840 978802.

Please read these Terms carefully. Nothing in these Terms affects your statutory rights.

2. Booking and acceptance

Bookings are taken on a first-come, first-served basis and may be made in person, by email or telephone. By making a booking, the parent or guardian confirms that they have read and agree to these Terms.

Payment in full is required at booking to secure a place, or within 24 hours of reserving a place where immediate payment is not convenient. A place is not guaranteed until payment is received.

If a child attends their first lesson and does not enjoy it, will not enter the water, becomes upset or is otherwise unable to continue, and the parent or guardian cancels the place, we will refund fees paid for the remaining lessons in that block. Further lessons are subject to the cancellation and refund terms below.

3. Term and holiday dates

Current and future term and holiday dates are published on our website. Dates are subject to pool availability and may be changed where reasonably necessary. We will provide as much notice as reasonably possible of material changes.

4. Payments and prices

Payment may be made by cash during rebooking week or bank transfer at other times. Customers are responsible for using the correct payment details and reference supplied by us.

We may change prices from time to time to reflect changes in costs. Price increases will not apply retrospectively to confirmed and paid bookings. Any new price will be made clear before renewal or a new booking.

5. Sibling discount

Families with three or more immediate siblings enrolled will receive a 15% discount. The discount does not apply to cousins, family friends or other relations.

6. Medical conditions, illness and additional needs

Parents and guardians must tell us before lessons begin, and promptly if circumstances change, about any medical condition, disability, allergy, learning difficulty or additional need that may affect a child’s safety, welfare or participation. Children should not attend lessons where they have an infectious illness or swimming would be contrary to medical or public-health advice. Refunds are not normally given for lessons missed due to short-term illness. For a broken limb, operation, long-term illness or another medical reason causing extended absence, please contact us to discuss the circumstances.

7. Changes to bookings

Occasionally we may need to change a lesson time because a child progresses or a class needs to be reorganised. If we cannot offer a suitable alternative, we will refund fees paid for the remainder of the term.

We cannot normally accommodate one-off changes of lesson day. For a permanent change request, contact us by email or telephone. We will use reasonable efforts to help but cannot guarantee availability.

8. Cancellations, missed lessons and refunds

Except for the first-lesson arrangement above, lessons missed by a swimmer are non-refundable and cannot normally be rearranged or carried over.

In exceptional circumstances, such as long-term illness causing numerous missed classes, lesson credits may be granted at our discretion. Holidays during term do not give entitlement to credits, refunds or class changes.

9. Cancellation by us, adverse weather and pool closure

We may change or cancel course dates where reasonably necessary. If we cancel a lesson, including because of pool closure, a pool problem, adverse weather making the venue inaccessible, teacher availability where suitable cover cannot be arranged, or another operational reason, the affected lesson will be credited to the swimmer’s account or refunded if preferred, in accordance with our existing lesson-credit arrangements.

Where possible, we will notify customers by email, text, telephone, Facebook or another reasonable method. Customers must keep contact details up to date.

10. Rebooking

Current swimmers have priority to re-enrol. To secure a place, payment must be received in full no later than 14 days from the rebooking date. Places are not guaranteed where payment is late. After the deadline, unsecured places may be offered to swimmers on class-change or waiting lists.

11. Teachers and staff

Lessons are delivered by appropriately qualified and experienced swimming teachers. Aquababies Yorkshire Ltd uses employees and self-employed teachers. Teachers and staff working with children are subject to safeguarding, training and checking requirements applicable to their roles and to the organisation.

Swimming teaching may involve appropriate physical contact where necessary for instruction, support and safety. Any such contact must be appropriate, necessary and consistent with safeguarding requirements. We may replace an advertised teacher or arrange cover where reasonably necessary.

12. Pool safety and emergencies

Swimmers, parents and guardians must follow venue rules and reasonable safety instructions. In an emergency, teachers and swimmers will follow the pool’s Emergency Action Plan and instructions given by authorised personnel.

13. Supervision

Parents and guardians are responsible for children in entrance, changing and other areas outside the lesson and until the teacher accepts the child into the lesson. Children must not be left unattended. A responsible adult must accompany children to and from lessons and remain in the vicinity of the pool while the child is swimming.

14. Swimming Hats, Goggles and Personal Equipment

All swimmers must wear a swimming hat during pool lessons and should bring suitable, properly fitted goggles where required.

Teachers cannot guarantee that spare swimming hats or goggles will be available or suitable.

Personal equipment is brought to lessons at the customer’s own risk, subject to rights and liabilities that cannot lawfully be excluded.

15. Valuables and lost property

Please do not leave valuables unattended. We do not accept responsibility for loss of or damage to personal property except where caused by our negligence or where liability cannot lawfully be excluded. We will use reasonable efforts to assist with lost-property enquiries.

16. Photography and filming

Photography, including camera phones, and video filming are not permitted during Aquababies Yorkshire Ltd lessons.

17. Behaviour and code of conduct

Swimmers must follow teacher instructions and venue rules and behave safely and respectfully. Parents and guardians must not distract swimmers or teachers, interrupt lessons or approach poolside except where permitted or in an emergency.

We do not tolerate bullying, discrimination, harassment, verbal abuse, physical aggression or unsafe conduct. We may issue warnings, require a person to leave or end a swimmer’s place where conduct is serious or persistent.

18. Complaints

If you are unhappy with our service, please contact us as soon as possible so we can consider and respond to your concerns.

Complaints involving safeguarding concerns will be handled under applicable safeguarding procedures and may be referred to appropriate external bodies where required.

19. Safeguarding

Everyone working for or on behalf of Aquababies Yorkshire Ltd has a responsibility to act on concerns about a child’s safety or welfare. Safeguarding concerns should be reported promptly using the company’s published safeguarding contact arrangements or, until separate safeguarding contact details are published, by emailing info@aquababies-yorkshire.co.uk. In an emergency or where a child is in immediate danger, contact the emergency services.

20. Data protection

We process personal information in accordance with our Privacy Notice and applicable data protection law.

21. Changes to these Terms

We may update these Terms where reasonably necessary because of changes to services, prices, venue arrangements, safety requirements, governing-body requirements or the law. Changes will not remove rights already arisen under an existing booking.

22. Governing law

These Terms are governed by the law of England and Wales.
